Judge Jim Gray is an honorable man but, unfortunately, once again is leading a statewide effort endorsing a tragic public policy position for the unrestricted use of marijuana.

It will be needed, of course, but we’d do well to put them on notice that we won’t stand stand for the kind of over-regulation that, say, methadone-maintenance treatment labors under today.

The U.S. federal government has failed to make public its own 1994 study that undercuts its position that marijuana is carcinogenic – a $2 million study by the National Toxicology Program. The program’s deputy director, John Bucher, says the study “found absolutely no evidence of cancer.” In fact, animals that received THC had fewer cancers. Bucher denies his agency had been pressured to shelve the report, saying the delay in making it public was due to a personnel shortage.
The Boston Globe reported Thursday (1-30-97) that the study indicates not only that the main ingredient in marijuana, THC, does not cause cancer, but also that it may even protect against malignancies, laboratory tests on animals show. The report comes on the heels of an editorial in the prestigious New England Journal of Medicine that favors the controlled medical use of marijuana, and calls current federal policy “misguided, heavy-handed and inhumane.”
The Clinton administration has said that doctors prescribing marijuana could be prosecuted for a federal crime. Marijuana has been reported to ease the pain, nausea and vomiting in advanced stages of cancer, AIDS and other serious illnesses, but the federal government claims other treatments have been deemed safer than what it calls “a psychoactive, burning carcinogen.” However, The Boston Globe says the government’s claim appears to be undercut by its own $2 million study.

That people are expected to take an oath to tell the truth in a legal proceeding says much about the sorry state of truth in America. Lies are generally protected under the First Amendment’s freedom of speech and press rule, unless someone is a drug czar who lies so much they need their very own law to protect them from lawsuits.
Criminal activity typically follows government lies, so it’s safe to assume that government lies can constitute a framework for committing crimes against humanity, such as torture, persecuting minorities, stealing the land of indigenous peoples using the drug laws as an excuse, or as a funding source, etc. Prosecuting government officials for such crimes is best achieved in the International Criminal Court (ICC). The ICC is typically approached after all other domestic legal remedies were tried and have failed, or justice is no longer possible because of a government’s neglect, corruption and so forth.
Under universal jurisdiction, lawsuits get filed with the ICC all the time. The rulings of the court can be unenforceable in certain countries, since the enforcement of international law relies heavily on the cooperative efforts of all the nations involved. Sometimes a symbolic victory is better than none at all. Plus, no one I know of has tried this approach yet with respect to drug war crimes.
For now, it might be possible to get help from the ICC in restricting the international reach of the DEA and other professional prohibitionists.
For instance, if a government official is suspected of being a war criminal, and they show up in the EU, a lawsuit can be filed to detain the war criminal and try them in a national court. Spain has always been good about this, noting their prosecution of Argentina’s mass killer, General Pinochet.
In fact, Spain’s excellent observance of international law is the reason George W. Bush and his fellow torture cronies can no longer set foot in Europe.

EZ, when it comes to dueling studies, which is what this would become in a court of law, if you were to print out every one of the studies that support our case, you’d need a fork-lift to haul them in…and the prohibs would need kiddie’s a beach bucket for theirs. I think the smoking issue is a guaranteed failure. The Know Nothing prohibitionists don’t have enough buffer space in their brains to hold more than “smoking is bad. mmm-kay?”
When I run into one of these clowns I start out mentioning that they don’t have a grasp of even the basic facts of the issue. Smoking is not required, and this is conflating the potential health hazard of smoking with cannabis. Vaporization is proven safe and preferred by a margin of 7-1 over smoking in peer reviewed research published in 2010.
Aside from smoking there’s edibles/drinkables, sublingual tinctures, topical salves/transdermal patches, inhalers like asthmatics use, eyedrops and suppositories. The latter is the most efficient delivery method after inhalation.
The other suggestion I like to make is that they study a little history and look at what the environment was like in the 19th century when cannabis was enjoyed and very popular. It was such a non-problem that it seems like there aren’t many people who don’t believe that cannabis was invented in 1964 by an unholy collaboration of Bob Dylan and the Beatles.
To find out what things looked like in America in the 19th century you should get a copy of “The Hasheesh Eater” by Fitz Hugh Ludlow, published in 1857. Less than $15 at Amazon. It also details the popularity of hash parlors that operated in every major US city in the middle 1800s. These people weren’t buying patent medicine at the drug store, they went to these hash parlors to get high. Why in the world would the environment be more than marginally different today than it was back then?

This article also appeared in the paper on the same day an article about a teenager who overdosed on prescription meds was reported. The parents were concerned with the child’s marijuana “abuse” (he smoked mj because he was a teenager and depressed; his friend had just passed away) The parents had him sent to a psychologist who eventually prescribed him anti-psychotics and opioid like sedatives. The teen passed away on the night of his friends funeral (who also passed from prescription drug overdose). His parents should have left well enough alone, I have never heard of anyone overdosing from cannabis, and there is research that proves cannabinoids are beneficial in patients with psychological problems.
PS The cop/physician/Orange County School Board Member needs to get his facts straightened out completely! Maybe he should also look in to the history of the D.A.R.E. program, as it has had its share of corruption, and has probably contributed to our young peoples’ drug consumption more than it has prevented drug use.
